Terms of Use

1. Agreement

These Terms govern use of My Digital Magnets, its website, widget, accounts, digital magnets, gifts, and designer features. By using the service, you agree to these Terms and the Privacy Policy at https://mydigitalmagnets.com/privacy.

Simple Apps Company is the publisher name supplied for this site. If the full registered legal entity name differs, it must replace this name before publishing.

2. Eligibility

You must be legally able to enter this agreement. Users below the age of legal consent must have permission from a parent or guardian. The service is not directed to children under 13 or below the minimum digital-consent age required in their country.

3. Accounts

You are responsible for your account, credentials, and activity. Provide accurate information and keep access secure.

Sign in may use Apple or email authentication. Do not impersonate another person, interfere with the service, or attempt unauthorized access.

4. Digital magnets

Magnets are digital items usable inside My Digital Magnets. They are not physical products, investments, securities, cryptocurrencies, or redeemable cash.

Buying or receiving a magnet does not transfer copyright, trademark rights, or ownership of the underlying artwork.

5. Location-based access

Certain magnets and purchase opportunities require a verified check-in. Location accuracy, supported destinations, time limits, availability, stock, and technical conditions may affect eligibility.

A verified destination currently creates a limited purchase window of 15 days. Eligibility may expire before checkout.

Do not falsify, manipulate, or automate location information.

6. Purchases

Digital purchases are processed through Apple’s In-App Purchase system and are also subject to Apple’s applicable terms.

The price presented by Apple at confirmation is authoritative. Applicable taxes and currency conversion may vary by storefront.

Current magnet purchases are non-consumable digital purchases unless explicitly identified otherwise.

Use Profile > Restore Purchases to restore eligible purchases associated with the Apple Account.

7. Refunds and revocations

Apple handles purchase billing and refund requests. Request refunds through https://reportaproblem.apple.com.

If Apple refunds or revokes a transaction, corresponding app access may be removed. Contact support@mydigitalmagnets.com if verified content is not delivered.

8. Gifts

A gift grants app access to the identified magnet according to the gift’s terms. Gift links may expire and can be claimed only by an eligible recipient. Current gift claim links expire after 15 days.

Do not publish private gift links where unintended recipients can access them.

Transfers may remove the relevant magnet from the sender once completed. Failed, expired, revoked, or duplicate gifts may be cancelled or restored according to the service’s custody rules.

9. Public fridges and user content

Depending on your visibility setting, your username, display name, profile image, magnet collection, fridge layout, and related information may be publicly viewable.

You retain ownership of content you submit. You grant Simple Apps Company a limited, worldwide, non-exclusive license to host, process, display, resize, and distribute that content only as needed to operate and promote the service.

Do not submit content that is unlawful, abusive, threatening, discriminatory, sexually exploitative, deceptive, infringing, malicious, or privacy-invasive.

We may investigate reports and remove content or suspend accounts that violate these Terms.

10. Designer submissions

You must own or have all necessary rights to submitted artwork, portfolio materials, and related content.

Submission does not guarantee acceptance, publication, payment, exclusivity, or assignment.

Any commission, revenue share, payment, tax, and licensing terms must be provided separately and accepted before commercial publication. Designer inquiries: creators@mydigitalmagnets.com.

11. Intellectual property

The app, software, branding, catalogue, original artwork, layout, and related materials belong to Simple Apps Company or their licensors.

You may not copy, scrape, reverse engineer, resell, redistribute, or create unauthorized derivative commercial products except where applicable law expressly permits it.

12. Acceptable use

You must not:

• Abuse, harass, threaten, or impersonate others.
• Upload malware or harmful content.
• Circumvent purchase, location, gift, inventory, or account controls.
• Automate scraping or excessive requests.
• Infringe intellectual-property or privacy rights.
• Use the service for unlawful activity.
• Interfere with security or availability.

13. Availability

We may change, suspend, or discontinue features, catalogue content, destinations, or online services. We do not guarantee uninterrupted availability.

Owned digital content will be handled in accordance with applicable law and Apple platform rules.

14. Account termination

You may delete your account through Settings > Delete account and local data. Instructions and an email fallback are available at https://mydigitalmagnets.com/account-deletion.

We may restrict or terminate accounts for fraud, abuse, unlawful conduct, security threats, or material violations of these Terms. Where required, we will provide notice or an appeal path.

15. Disclaimers

The service is provided “as is” and “as available” to the extent permitted by law. Travel, location, catalogue, and cultural information may contain errors and should not be used for navigation, safety, emergency, or legal decisions.

Nothing in these Terms excludes mandatory consumer rights.

16. Limitation of liability

To the maximum extent permitted by law, Simple Apps Company is not liable for indirect, incidental, special, or consequential loss arising from use of the service.

This limitation does not apply where prohibited by law, including liability that cannot legally be excluded.

17. Governing law

These Terms are governed by the laws of Portugal, without removing mandatory consumer protections available in the user’s country.

Courts located in Portugal will have jurisdiction except where consumer law provides otherwise.

18. Apple terms

Apple is not responsible for operating or supporting My Digital Magnets. Apple and its subsidiaries may enforce applicable end-user terms as third-party beneficiaries.

19. Changes and contact

We may update these Terms. Continued use after an effective update constitutes acceptance where permitted by law.
